Whistleblowing – Notification Process

NESS Czech s.r.o., ID No.: 45786259, with its registered office at V Parku 2335/20, Prague 4, 148 00, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 17113 (hereinafter referred to as “NESS”), in accordance with Section 9 of Act No. 171/2023 Coll., on the protection of whistleblowers (hereinafter referred to as the “Act”), provides the following information on how to submit a notification of a violation that has occurred or is about to occur within NESS or in connection with a third party related to NESS. 

Selected persons (hereinafter referred to as the “Whistleblower”) can submit a notification either through NESS’s internal reporting system or via the external notification system operated by the Ministry of Justice. 

I. Types of Violations That May Be Reported

According to the Act, violations that may be reported include: 

  1. Acts that constitute a criminal offense. 
  2. Violations classified as an offense with a fine of at least CZK 100,000. 
  3. Breaches of obligations under the Act itself. 
  4. Violations of other laws or EU regulations related to: 
    • Financial services, auditing, and related activities 
    • Corporate income tax 
    • Prevention of money laundering and terrorist financing 
    • Consumer protection 
    • Compliance with product safety and requirements 
    • Transport, traffic, and road safety 
    • Environmental protection 
    • Food and feed safety, as well as animal health 
    • Radiation protection and nuclear safety 
    • Competition, public auctions, and public procurement 
    • Protection of public order, life, and health 
    • Data protection, privacy, and security of electronic communications and information systems 
    • Protection of EU financial interests 
    • Functioning of the internal market, including state aid and competition law. 

II. Who Can Submit a Notification (Whistleblower)

The following individuals are entitled to submit a notification: 

  1. Members of NESS’s statutory body. 
  2. Employees of NESS working under employment contracts, agreements on work performance, or agreements on work activities. 
  3. Natural persons representing NESS. 
  4. Collaborators providing work or services for NESS. 
  5. Third-party contractors or their employees performing delegated activities for NESS. 
  6. Volunteers, interns, or individuals on professional practice within NESS. 
  7. Applicants or prospective applicants for the roles mentioned above. 

III. How to Submit a Notification to NESS 

Notifications may be submitted through the following internal channels: 

  1. Email: Send an electronic notification to the designated email address: cz-whistleblowing@ness.com. Access to this email is restricted to the Authorised Person. 
  2. Phone: Call the Authorised Person at the published phone number: +420 606 694 579. 
  3. Oral Notification: Request a meeting with the Authorised Person via email or phone to arrange a suitable date and time. 
  4. Written Notification: 
    • Send a letter to NESS Czech s.r.o., V Parku 2335/20, 148 00, Prague 4.
    • The letter must be written in Czech, in a machine-readable format, and sealed in an envelope marked: 

“WHISTLEBLOWING – TO THE ATTENTION OF THE AUTHORISED PERSON – DO NOT OPEN.” 

  • Failure to seal the envelope properly or include the marking may compromise confidentiality. 

IV. External Notification System

Alternatively, whistleblowers can submit their notifications through the external reporting system operated by the Ministry of Justice. This system is available at:
